Is Your Art Business Subject To California's Newly Implemented Consumer Privacy Act?

AB375, otherwise known as "The California Consumer Privacy Act," went into effect on January 1, 2020. The law puts a slew of new burdens on certain businesses selling goods or services to Californians. Is your art business one of them?

Probably not.

Does your art business have $25 million a year in revenue?

In operating your art business do you collect personal information (email address, credit card information, health data, online behavior, etc.) on more than 50,000 consumers or their devices each year?

Does selling people's personal information account for 50% or more of your art business's annual revenue?

If you answered "no" to all of these questions, then you don't fit the definition of "business" subject to the new law. In case you want to see that definition for yourself, take a look at section 1798.140(c) here.
